Attorney Mangones successfully defeated claims of unsuitability, misrepresentation and violations of M.G.L. c. 93A.
In an explained decision, the FINRA arbitration panel found that all of the primary claims were barred by the three year statute of limitations, and that the c.93A claim must also be rejected because it was wholly derivative of the the claims that were denied.
The arbitrators further stated that even though the type of transactions at issue were complex and came with the potential of abuse, that they would have denied relief here even if the claims were not barred by the statute of limitations.
